Labadi Beach Hotel Secures Court Injunction Against Polo Beach Club Encroachment
The Land Division of the High Court in Accra has granted an interim injunction in favor of Labadi Beach Hotel, restraining Spartan Ives Limited, operators of the Polo Beach Club, from encroaching on its property.
Issued on December 19, 2024, the injunction follows a legal suit initiated by Hotel Investments (Ghana) Limited, owners of the hotel, to reclaim 0.54 acres of disputed land.
Court Directive
The court’s directive explicitly prohibits Spartan Ives Limited and its affiliates from the following:
- Trespassing on the hotel’s property: This includes using the disputed 0.54 acres as a car park, pathway, or event venue.
- Operating or hosting events: Any activities by the Polo Beach Club on the disputed property or adjoining restricted areas are barred.
- Violating the beachfront lease: Usage of the beachfront adjacent to the hotel’s property in breach of the November 27, 1990 lease agreement is forbidden.
The injunction is effective for 10 days, with warnings of contempt proceedings should the defendants fail to comply.
Labadi Beach Hotel’s Position
Labadi Beach Hotel, a premier 5-star resort in Ghana, has taken this legal step to safeguard its assets and maintain its reputation. The hotel’s management, led by David Eduaful, submitted affidavits asserting their property rights and addressing concerns of encroachment.
