High Court Orders EC to Re-Collate Results in Ablekuma North and Tema Central Constituencies

The Accra High Court has granted applications filed by the New Patriotic Party (NPP) to compel the Electoral Commission (EC) to re-collate outstanding constituency results in Ablekuma North and Tema Central.

Ablekuma North Case

Justice Forson Agyapong of the Accra High Court General Jurisdiction 2 ruled that the EC failed to collate results from 62 out of 281 polling stations in the Ablekuma North Constituency. The judge noted evidence of a demand for the EC to act, which it either failed or refused to do.

The court ordered the EC to:

Collate the results from the 62 outstanding polling stations.

Add these results to the already collated figures.

Declare the winner based on the final tally.

Additionally, the Inspector General of Police (IGP) was directed to provide armed security during the collation exercise to ensure order and safety.

Tema Central Case

In a similar ruling, Justice Agyapong addressed the Tema Central constituency case. The judge found that:

The EC did not complete collation for all polling stations before declaring a winner.

The person who declared the winner was not the authorized returning officer, violating electoral laws.

The court ordered the EC to:

Collate results from the two remaining polling stations.

Add them to the already collated results to declare the winner.

The IGP was also instructed to ensure adequate security for the EC to carry out the collation exercise.

These rulings affirm the court’s commitment to upholding transparency and adherence to electoral laws in the collation and declaration of results.
