Martin Kpebu Ready to Defend Gifty Oware Amid NIB Detention Concerns

Accra, March 8, 2025 – Private legal practitioner Martin Kpebu has expressed his readiness to legally represent Gifty Oware, the former Deputy Executive Director of the National Service Authority (NSA), if the National Intelligence Bureau (NIB) violates her constitutional rights following her arrest.
Oware was picked up by the NIB on Friday, March 7, over her alleged involvement in the Ghost Names scandal.
Kpebu Cautions NIB on 48-Hour Detention Rule
🔹 Speaking on TV3’s The Key Points, Kpebu reminded the NIB that Ghana’s Constitution requires that any detained individual be released or arraigned before a court within 48 hours.
🔹 “If the NIB breaches the 48-hour rule, I will be happy to represent Gifty Oware. As citizens, we all must jump in because we don’t know what could happen tomorrow,” he stated.
Gifty Oware’s Return to Ghana and Legal Process
✅ Oware voluntarily returned to Ghana earlier this week amid speculation that she would be arrested upon arrival at Kotoka International Airport.
✅ Kpebu argued that since she willingly came back, there was no reason to keep her in detention beyond 48 hours.
✅ He referenced a 2020 Supreme Court directive by the Chief Justice, emphasizing that law enforcement agencies must follow due process.
Courts Can Sit on Weekends and Holidays
📌 Kpebu pointed out that courts in Ghana have previously sat on weekends and public holidays for urgent cases.
📌 “Even recently, some NDC cases were heard on public holidays. I, sitting here, have been to court on Saturdays and even public holidays,” he noted.
Kpebu urged the NIB to expedite the legal process to ensure that Oware’s constitutional rights are fully protected.
