Supreme Court to Rule on Akwatia MP Ernest Kumi’s Injunction Case on April 30

Accra, March 25, 2025 – The Supreme Court has adjourned to April 30 to deliver a ruling on an application filed by Akwatia MP, Ernest Kumi, seeking to overturn an interim injunction that barred his swearing-in on January 6, 2025.
Despite the injunction, Kumi proceeded with his swearing-in, leading to a High Court contempt charge. His legal team, led by Gary Nimako Marfo, is now petitioning the Supreme Court to quash the injunction and prevent the High Court judge from further handling the case.
Dispute Over Election Petition Timing
The injunction stems from an election petition filed by NDC parliamentary candidate, Henry Boakye, on December 31, 2024. However, Kumi’s legal team argues that under electoral laws, such petitions can only be filed within 21 days of the official gazette publication of election results. They claim the gazette was issued on January 6, 2025, making Boakye’s petition premature.
On the other hand, Boakye’s legal team, led by Bernard Bediako Baidu, contends that the Electoral Commission (EC) had already gazetted the results on December 24, 2024. They presented Gazette No. 234, which they claim is the authentic document, challenging the accuracy of Kumi’s version.
EC’s Position and Supreme Court Consideration
The EC’s legal representative, Justin Amennuvor, disclosed that neither version of the gazette was presented to the High Court at the time of its ruling. Instead, the judge relied on an online publication cited by NDC lawyers to determine jurisdiction.
Amennuvor argued that since the High Court did not have the official gazette record, its ruling should be overturned.
A five-member Supreme Court panel, chaired by Justice Gabriel Pwamang, will now decide on April 30 whether to uphold the injunction or dismiss it, paving the way for a resolution of the Akwatia parliamentary dispute.
