Dr. Nii Kotei Dzani: President Mahama Has No Direct Role in Chief Justice’s Removal

Accra, March 26, 2025 – Former Council of State member, Dr. Nii Kotei Dzani, has clarified that President John Dramani Mahama plays no direct role in the removal of the Chief Justice, emphasizing that the process is strictly guided by constitutional procedures.

President’s Role Limited to Petition Submission

Dr. Dzani’s remarks come amid ongoing controversy over a petition seeking the removal of Chief Justice Gertrude Torkonoo. The petition, which was forwarded by President Mahama to the Council of State, has sparked debate, with critics—including Manhyia South MP Nana Agyei Baffour Awuah—warning of potential threats to Ghana’s judiciary and governance.

✔️ Dr. Dzani, speaking on Eyewitness News, stated that the President’s involvement is purely procedural, as he only forwards petitions to the Council of State without influencing the decision.
✔️ He noted that such petitions are not unusual, as the Council of State receives two or three petitions annually regarding the Chief Justice.

Council of State’s Decision-Making Process

Dr. Dzani further explained that the handling of such petitions depends on timing and the Council of State’s session status.

🔹 If the Council of State is in session, the petition is immediately reviewed.
🔹 If not in session, the chairman may call an emergency meeting since the council has a limited timeframe to act on petitions.
🔹 A special committee may be formed to assess the case against the Chief Justice. If grounds for removal are established, the Council of State will then communicate the findings to the President.

Concerns Over Judicial Independence

Despite these clarifications, critics warn that any attempt to remove Chief Justice Torkonoo without solid grounds could undermine judicial independence. The debate continues as legal and political analysts weigh the potential ramifications of the petition.
