Supreme Court Dismisses AG’s Objections Over Chief Justice Injunction Case

Accra, May 6, 2025 — The Supreme Court has dismissed two objections raised by the Attorney General, Godfred Yeboah Dame, regarding the composition of the panel hearing a motion to injunct proceedings related to the removal of the Chief Justice.

Mr. Dame, representing plaintiff Vincent Ekow Asafuah, had argued for the recusal of Acting Chief Justice Paul Baffoe-Bonnie, claiming he stood to benefit from the outcome of the proceedings and should not preside over the case. He also objected to the reconstitution of the original panel, which initially included Justices Samuel Asiedu, Ernest Gaewu, Richard Agyei Frimpong, Yaw Asare Darko, and was presided over by Prof. Henrietta Mensa-Bonsu.

The current panel—comprising Justices Yonny Kulendi, Amadu Tanko, Henrietta Mensa-Bonsu, Ernest Gaewu, and presided over by Justice Baffoe-Bonnie—was the subject of Dame’s constitutional challenge, citing Article 157(3), which he argued prohibits changes to a panel that has begun hearing a case.

However, in its ruling, the apex court dismissed both objections. The court held that Article 144(6) of the 1992 Constitution grants the Acting Chief Justice full authority to perform the duties of the substantive Chief Justice, including constituting panels. Thus, the call for Justice Baffoe-Bonnie’s recusal was unfounded.

The court further stated that the constitutional provisions cited by the Attorney General were not applicable in this context, effectively clearing the path for the panel to proceed with hearing the substantive motion.
