Ken Ofori-Atta Fails to Honour OSP Date Due to Health Concerns, Legal Team Offers Virtual Cooperation

ACCRA, June 1, 2025 — Former Finance Minister Ken Ofori-Atta will not appear before the Office of the Special Prosecutor (OSP) on Monday, June 2 as earlier scheduled, following a reported deterioration in his health, sources close to him have confirmed.
His legal team has notified both the OSP and the Human Rights Court, submitting medical reports and confirming that Mr. Ofori-Atta has upcoming surgical procedures. The development has once again complicated the ongoing legal tussle between Mr. Ofori-Atta and the OSP, led by Special Prosecutor Kissi Agyebeng.
The OSP had previously hinted at the possibility of re-declaring Mr. Ofori-Atta a wanted person if he failed to report physically on the said date, stirring speculation about another arrest warrant or INTERPOL involvement.
Legal Offer for Virtual Participation
In a proactive move, Mr. Ofori-Atta’s legal team has proposed a virtual appearance, invoking provisions of the Electronic Transactions Act to enable him to give a Cautioned Statement remotely while undergoing treatment. The OSP has not yet issued a formal response to this offer.
Background of Investigation
Mr. Ofori-Atta is under investigation for five major cases, involving financial irregularities and questionable procurement practices:
- Petroleum and Minerals Revenue Assurance
– Strategic Mobilisation Ghana Ltd & GRA contract. - Electricity Company of Ghana – BXC Contract Termination
- National Cathedral Project
– Alleged procurement breaches and financial mismanagement. - Ambulance Procurement Deal
– Ministry of Health’s contract with Service Ghana Auto Group. - GRA Tax P-Fund Management
Timeline of Key Events:
- Jan 2025: OSP names Ofori-Atta a suspect in five cases.
- 10 Feb 2025: He fails to appear, citing indefinite medical treatment abroad.
- 12 Feb 2025: OSP declares him a fugitive.
- 18 Feb 2025: Provides return date in May; removed from wanted list.
- March 2025: Files lawsuit at Human Rights Court over “unlawful” fugitive declaration.
- 28 March 2025: Court hears application to restrain OSP from future declarations.
- 28 May 2025: OSP reaffirms the June 2 reporting deadline via official X post.
Upcoming Court Ruling:
- June 18, 2025: The Human Rights Court will rule on Mr. Ofori-Atta’s motion to permanently restrain the OSP from listing him as a fugitive and to compel removal of the prior wanted declaration from its social media.
Possible Consequences if He Fails to Appear:
If the OSP does not accept the virtual appearance and Mr. Ofori-Atta fails to report physically:
- He will be re-listed as a wanted person.
- The OSP will declare him a fugitive again.
- The office will initiate an INTERPOL Red Notice to facilitate his international arrest.
The situation remains tense as legal, political, and public scrutiny intensifies over the handling of one of Ghana’s most high-profile anti-corruption investigations.
