Supreme Court Nominee Justice Sir Dennis Adjei Asserts Judicial Impartiality in LGBTQ+ Rights Cases

Accra, June 18, 2025 — Justice Sir Dennis Dominic Adjei, a Court of Appeal judge and nominee for the Supreme Court, has emphasised the need for judicial impartiality and the separation of personal religious beliefs from legal rulings, particularly in cases involving LGBTQ+ rights.
Appearing before Parliament’s Appointments Committee on Monday, June 16, Justice Adjei addressed questions about how he would handle cases related to same-sex rights, considering his well-known Catholic background.
“When we talk about our faiths, whether Christian, Muslim, or any other, it is a personal matter,” he said. “But when you are in the courtroom, you have taken an oath to be impartial, regardless of who appears before you.”
Justice Adjei noted that while faith is important in personal life, it cannot be allowed to interfere with judicial duties. He highlighted his current position as a judge at the African Court on Human and Peoples’ Rights, where he has handled complex human rights cases—including those involving sexual orientation—with strict adherence to legal principles.
“If any matter comes before me, whether it concerns same-sex issues or something else, I will consider the facts and apply the law. My faith will not influence the outcome. Anything else would be a failure to discharge my duty as a judge,” he added.
Guarding the Integrity of the Legal System
Justice Adjei further warned that letting religious beliefs dictate court decisions could undermine the independence and integrity of Ghana’s judicial system.
“If faith were to guide judgments, then each religious group might want someone on the bench to speak for their interest. That should not be the case,” he said.
His comments come amid heated national debate over LGBTQ+ legislation in Ghana, with various groups, including faith-based organisations and civil rights advocates, lobbying on opposing sides of the issue.
Justice Adjei’s principled stance is likely to resonate with legal purists who advocate for a judiciary that is not swayed by popular sentiment or religious bias, but instead guided by constitutional mandates and the rule of law.
His confirmation, if approved, would bring a seasoned and internationally experienced jurist to Ghana’s highest court at a time when human rights and legal neutrality are increasingly under public scrutiny.
