
A private citizen, Daniel Ofori-Atta, has formally petitioned President John Dramani Mahama, calling for the removal of Supreme Court Justice Yonny Kulendi over allegations of judicial misconduct.
The petition, submitted on September 30, 2025, accuses Justice Kulendi of alleged improper interference in High Court proceedings related to the ongoing ambulance scandal case, Republic v. Cassiel Ato Forson & 2 Others.
Allegations
According to the petitioner, Justice Kulendi’s actions constitute breaches of the Code of Conduct for Judges and Magistrates, with the potential to undermine judicial independence and erode public trust in Ghana’s judiciary.
This is not Mr. Ofori-Atta’s first move against Justice Kulendi. In a previous petition, he urged the Criminal Investigations Department (CID) to investigate both the judge and businessman Richard Jakpa, alleging that Mr. Jakpa leveraged a familial relationship with Justice Kulendi to obstruct justice.
He further claimed that the aim was to either secure Jakpa’s acquittal or have the prosecution halted by then Attorney-General Godfred Yeboah Dame.
The petition suggests that these alleged actions may amount to criminal offences of interference with legal proceedings under Ghana’s Criminal Offences Act, 1960 (Act 29).
Next Steps Under the Constitution
While the outcome remains uncertain, Article 146 of the 1992 Constitution provides a strict process for removing a Justice of the Supreme Court. The procedure involves an initial determination by the President, followed by the establishment of a committee of inquiry by the Chief Justice — or another authority if the Chief Justice is the subject of the petition.
For now, the Office of the President has acknowledged receipt of the petition, leaving the next steps to constitutional due process.
