Former Chief Justice Can Challenge Removal in Court – Dafeamekpor

The Majority Chief Whip, Rockson-Nelson Dafeamekpor, has stressed that former Chief Justice Gertrude Araba Esaaba Sackey Torkornoo has the legal right to challenge her removal from office in the courts.
Justice Torkornoo was removed on Monday, September 1, 2025, under Article 146(9) of the 1992 Constitution, following the recommendation of a committee established to investigate a petition filed by a citizen, Mr. Daniel Ofori. Her removal took immediate effect after President John Dramani Mahama’s approval of the committee’s findings.
Speaking on Channel One TV’s The Point of View, Dafeamekpor explained that the former Chief Justice could still contest the committee’s decision before the Supreme Court.
“When Charlotte Osei [former Electoral Commission Chairperson] was removed under Article 46 procedure, Kweku Baako [renowned journalist] went to the Supreme Court to challenge it. Isn’t it? The Chief Justice can go to the Supreme Court to challenge the findings and recommendations of the committee, which she has the right,” he said.
He emphasized that removal through such a constitutional process does not necessarily end the matter for the affected individual.
“Nobody should think that this is the end. Kweku Baako didn’t find favour with the court. It doesn’t mean that the findings of the committee cannot be challenged in the Supreme Court; it can,” he added.
